Media Programming Service (EPROM/Flash) for Retro Cartridges — Content Provided by the Customer

Full Description:

We offer a service to program memory media (EPROM, Flash, and other non-volatile memories used in retro cartridges) with data provided by the customer, intended for use in their own cartridge—both in products from our offer (DIY kits, ready-made PCBs) and in media supplied by the customer.

The service is available for various platforms and cartridge formats (e.g., VIC-20, C64/128, Atari 8-bit, ZX Spectrum, MSX, and others—depending on the programming equipment we have), with the specific format, size, and memory bank division determined individually based on the target hardware and the files provided.

Due to the nature of the service—recording content provided by third parties—we approach it with special care:

• The service is aimed at owners of their own software, homebrew creators, and individuals with legally owned backup copies.
• We do not search for, select, or suggest content for recording—the decision about the content lies solely with the customer.
• The execution of the order requires the submission of a declaration described in the Service Terms (§2).
• We reserve the right to refuse to fulfill the order without providing specific reasons, particularly in cases of doubts about the order's legality.

How it works:

1. Contact/order with a description of the target hardware (platform, cartridge type, media capacity).
2. Sending files along with acceptance of the declaration included in the Service Terms.
3. Technical verification of the files (format, size, checksum, compliance with the target addressing).
4. Media recording and shipping—either standalone or as part of the ordered kit/cartridge.

TERMS OF SERVICE FOR MEDIA PROGRAMMING (EPROM)

§1. Service Scope

1. The service provider offers a technical service consisting of recording digital data (binary files) provided by the customer onto memory media (EPROM, Flash, or other non-volatile memory) intended for use in a cartridge for retro computers, regardless of the target platform (e.g., Commodore VIC-20/64/128, Atari 8-bit, ZX Spectrum, MSX, and others).
2. The specific type of media, its capacity, memory bank division, and addressing method are determined individually for each order, depending on the target hardware and the specifics of the provided files.
3. The service is purely technical—the service provider does not interfere with the content of the provided files beyond actions necessary for proper recording (e.g., trimming headers, padding, combining multiple files into a single binary image).
4. The service provider does not offer services for selecting, searching for, or providing software (games, ROMs) protected by copyright.

§2. Customer Declaration

1. By placing an order for the programming service with their own content, the customer declares that:
   • They have full rights to the provided files (these are programs of their own authorship, freeware software, public domain, or legally owned backup copies of software in their possession).
   • They assume full and sole legal responsibility for the content, origin, and legality of the provided files.
   • They release the service provider from any liability arising from copyright or other third-party rights violations related to the provided content.
2. The declaration mentioned in point 1 is made by checking the appropriate checkbox in the order form or in the content of the message sending the files.

§3. Service Provider's Responsibility

1. The service provider verifies the provided files solely for technical compliance (format, size, binary structure correctness) and reserves the right to refuse the order if the files are damaged, non-compliant with the specifications, or if there is a justified suspicion that the content is clearly unlawful (e.g., directly referencing commercially distributed, copyrighted software without legal justification).
2. The service provider is not responsible for:
   • The functionality of the provided software on the target hardware.
   • The compliance of the addressing/memory mapping indicated by the customer with the actual requirements of the provided program.
   • Claims by third parties arising from the content provided by the customer.
3. The service provider's responsibility is limited to performing the service according to the technical specification (§4) and refunding the service cost in case of defects resulting from the service provider's error (e.g., incorrect recording, damaged chip).

§4. Technical Specification of the Order

1. The customer specifies the target hardware platform and the type/model of cartridge or media for which the recording is to be prepared.
2. The customer provides files in a format and size compliant with the media's specifications (determined individually for the order—e.g., maximum number of files, allowable size of a single file, format .bin/.prg/other), along with an indication of file allocation to memory banks and target addresses in the address space of the respective platform.
3. Files that do not meet the established specifications will be rejected, and the customer will be informed with a request for correction and resubmission.

§6. Final Provisions

1. Placing an order for the programming service with their own content is equivalent to accepting these Terms.
2. Matters not regulated by these Terms are subject to the general sales conditions of the store and Polish law, in particular, the Civil Code and the Copyright and Related Rights Act.
